Knowledgeworks Foundation provides this website and blog (collectively, the “Site”) to facilitate and encourage the sharing of ideas and materials to improve and advance the field of education. This Site contains some content that is ours and a significant amount of content that has been submitted by users of this Site or other third parties.
Therefore, KnowledgeWorks Foundation is not responsible for any materials that are posted, transmitted or otherwise made available by users on or through this Site, including but not limited to its blog, message boards, newsgroups, file areas, bulletin boards or any other part of the KnowledgeWorks Foundation Site.

Should KnowledgeWorks notice that a post or transmission is objectionable and/or appears to violate these Terms of Use, as determined in KnowledgeWorks Foundation’s sole discretion, then you agree that KnowledgeWorks Foundation may edit, refuse to post or transmit, or remove any such information or materials, in whole or in part. KnowledgeWorks Foundation also reserves the right at all times to disclose any information necessary in its sole discretion to satisfy any law, regulation, or governmental request.
2. Respecting the Rights of Others.

You also may not use a screen name that suggests the availability of content that KnowledgeWorks Foundation, in its sole discretion, considers to be libelous, defamatory, obscene, abusive, pornographic, threatening, an invasion of privacy, illegal, an advertisement of goods or services or a solicitation of funds, or otherwise objectionable. You agree to not attempt to conceal or disguise your screen name in any communication with KnowledgeWorks Foundation or through the Site.
4. Conduct and Communication.
KnowledgeWorks Foundation may elect in its sole discretion to monitor some, all or none of the posts, uploads, transmissions or materials otherwise made available on or through the Site for adherence to state and federal law and these Terms of Use. You agree to use the Site only for lawful purposes. Any conduct by you that in KnowledgeWorks Foundation’s sole discretion restricts or inhibits any other person or entity from using or enjoying the benefits of the Site or other service offered by KnowledgeWorks Foundation shall entitle KnowledgeWorks Foundation to immediately terminate your access to the Site without notice to you.

If you receive a notice of copyright infringement for material you have posted on KnowledgeWorks Foundation’s website, you must notify us immediately at 2020forecast@kwfdn.org so that we may promptly address the matter.
We will investigate notices of copyright infringement and take appropriate actions under the Digital Millennium Copyright Act.
7. Interference with Operation of the Site.
You agree not to post or transmit any materials to the Site that contain software viruses or any other computer code, files or programs that are designed to interrupt, destroy or limit the functionality of the Site or KnowledgeWork Foundation’s software, hardware or other equipment.
8. Indemnity.

9. Disclaimer of Warranties and Limitation of Liability.

10. Governing Law and Jurisdiction.
You agree that Ohio law will govern the interpretation of these Terms of Use, without reference to Ohio’s conflicts of laws rules or principles. Further, you agree that any action or proceeding brought by you against KnowledgeWorks Foundation must be brought in an Ohio state or federal court located in Hamilton County, Ohio, and you consent to the jurisdiction of such courts in any action or proceeding and waive any objection to such courts having venue in such action or proceeding.
